Police in Marseilles, France, have arrested a pair of identical twin brothers because they're unsure which of them might be a serial rapist. DNA evidence helped police track down the twins, 24-year-old Yohan and Elwin, but they're reportedly so alike that regular DNA tests can't identify which of them allegedly sexually assaulted six women between September and January. Both brothers deny the charges, so cops are holding them both without bail until they conduct special tests to pick apart their DNA, which will reportedly cost up to 1 million euros ($1.3 million).
While this is a very unusual case, it is troubling that the police have locked up a man they are fairly certain is completely innocent -- they just don't know which one.
The comments under the news story, found here, are evidence that our educational system is not teaching our citizens about Blackstone's formulation, due process, or, for that matter, justice. They further underscore the necessity of this blog. Here are a few:
"Wow just shoot them both! No biggie!"
"Put them in a line up....no test their dna....no, well fu*k i dont know! Shoot 'em both and let God figure it out!"
"Spit the difference. Charge each one with three of the six assaults."
"Draw and quarter the best suspect....the other one will talk rather than face the same...."
"Well,we've got it down to two suspects FLIP!"
"What if they are both guilty? Split the prison sentence?"
"Just shoot em both obviously there's something messed up in their DNA."
". . . If they are identical then the bad seed is in both so take the case to court charging them both...Not fair if one is truely innocent but then, no one said life is fair . . . ."
"KEEP THEN BOTH IN A HOLDING CELL TOGATHER, EVENTUALLY THE INNOCENT ONE WILL START TO BEAT THE CRAP OUT OF THE GUILTY ONE, UNLESS THEY'RE BOTH QUILTY; IN THAT CASE SCENARIO MALE CASTRATION SHOULD SOLVE THE PROBLEM, THEN PUT IN A PRISON CELL WITH BIG BUBBA."
"Want to find out who the guilty brother is in a matter of seconds? Simply lock them both in a room together and watch the innocent brother kicks the living snot out of the guilty one for dragging him through this legal trouble."
"Pull the old King Solomon trick: tell them that they both will be executed, since the police will then know they killed the killer. Hope that the murderer confesses to save his twin."
